Terms of Service
Acceptance of Terms & Eligibility
These Terms of Service ("Terms," "Agreement") constitute a legally binding electronic agreement between you ("User," "Client," "you") and Attenomy ("Attenomy," "we," "us," or "our") pursuant to the Indian Information Technology Act, 2000, and international electronic contracting laws.
By browsing, accessing, or using attenomy.com, our software platforms, AI automation systems, APIs, or consulting services (collectively, the "Services"), you acknowledge that you have read, understood, and unconditionally agree to be bound by these Terms. If you do not agree with any provision of these Terms, you must immediately cease all access to and use of the Services.
You represent and warrant that you are at least 18 years of age (or have reached the age of majority in your jurisdiction) and possess the full legal capacity, power, and authority to enter into this Agreement on behalf of yourself or the entity you represent.
Description & Scope of Services
Attenomy engineers high-performance AI automation pipelines, B2B and B2C SaaS platforms and applications, digital infrastructure consulting, and Creator & Audience Monetization Infrastructure (including bespoke digital InfoProducts, sales funnel architectures, community platforms, and performance revenue-split partnerships).
Creator Partnership & Revenue-Share Terms: Where Attenomy partners with content creators or publishers under a revenue-sharing engagement:
- Revenue Allocation: Net revenue (gross receipts less third-party payment gateway transaction fees, mandatory digital taxes/VAT, and customer refunds/chargebacks) is distributed strictly pursuant to the executed Partnership Agreement or Statement of Work.
- IP & Brand Sovereignty: Creators retain full ownership of their personal brand, likeness, voice, and proprietary subject-matter recordings. Attenomy retains all intellectual property rights to its proprietary software, checkout pipelines, conversion funnel code, automation logic, and architectural designs.
- Performance Disclaimer: Product revenue depends on audience engagement, niche authority, traffic volume, and market conditions. While Attenomy deploys institutional-grade engineering and optimization, no specific revenue volume or conversion metric is guaranteed.
Attenomy reserves the absolute right, at its sole discretion and without prior notice or liability, to modify, update, suspend, enhance, throttle, or discontinue any feature, tool, API endpoint, or aspect of the Services.
Acceptable Use Policy & Prohibited Conduct
You agree not to engage in any prohibited activities, including but not limited to:
- Attempting to decompile, reverse engineer, disassemble, decrypt, or extract source code or underlying architecture from Attenomy systems.
- Using automated scrapers, bots, spiders, crawlers, or unauthorized harvesting scripts without explicit written consent.
- Interfering with, disrupting, or launching Denial of Service (DoS/DDoS) attacks against our servers, network nodes, or connected APIs.
- Bypassing authentication, executing unauthorized penetration testing, vulnerability scanning, or security probing.
- Submitting adversarial prompt injections, malicious payloads, corrupted data, or harmful automated instructions into AI workflows.
- Violating any local, state, national, or international statute, privacy regulation, or third-party intellectual property rights.
Intellectual Property & Proprietary Rights
All intellectual property rights in and to the Services—including all source code, software, algorithms, workflows, user interfaces, design systems, visual assets, trademarks, logos, domain names, patents, trade secrets, and documentation—are and shall remain the exclusive property of Attenomy and its licensors.
Subject to compliance with these Terms, Attenomy grants you a limited, non-exclusive, non-transferable, revocable license to access and view the website content strictly for personal or internal business evaluation. No other rights are granted by implication, estoppel, or otherwise.

ATTENOMY EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, FREEDOM FROM VIRUSES, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
ATTENOMY DOES NOT WARRANT OR GUARANTEE ANY SPECIFIC BUSINESS, FINANCIAL, TECHNICAL, OR OPERATIONAL OUTCOME RESULTING FROM THE USE OF OUR SERVICES, PLATFORMS, OR AI AUTOMATION WORKFLOWS.
Maximum Limitation of Liability & Liability Cap
A. Exclusion of Consequential Damages: IN NO EVENT SHALL ATTENOMY, ITS FOUNDERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES WHATSOEVER—INCLUDING DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, WORK STOPPAGE, SYSTEM FAILURE, COMPUTER MALFUNCTION, OR BUSINESS INTERRUPTION—ARISING OUT OF OR IN CONNECTION WITH THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE, OR OTHERWISE), EVEN IF ATTENOMY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
B. Total Aggregate Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATTENOMY'S TOTAL CUMULATIVE AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL BE STRICTLY LIMITED TO AND SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO ATTENOMY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE THOUSAND INDIAN RUPEES (INR ₹1,000 / APPROX. $12 USD), WHICHEVER IS LOWER.
Indemnification & Hold Harmless
You agree to defend, indemnify, and hold harmless Attenomy, its founders, officers, directors, employees, contractors, agents, subsidiaries, and affiliates from and against any and all claims, liabilities, losses, damages, judgements, awards, costs, expenses, and reasonable attorneys' fees arising out of or resulting from: (i) your access to or use of the Services; (ii) your violation of these Terms or any applicable law; (iii) any breach of representations or warranties made by you; or (iv) your infringement of any intellectual property, privacy, or proprietary rights of any third party.
Mandatory Binding Dispute Resolution & Arbitration

Class Action & Representative Action Waiver
YOU AND ATTENOMY AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, MULTI-PLAINTIFF, OR REPRESENTATIVE ACTION. YOU EXPRESSLY WAIVE ANY RIGHT TO COMMENCE, JOIN, OR PARTICIPATE IN ANY CLASS ACTION LAWSUIT OR CLASS ARBITRATION AGAINST ATTENOMY.
One-Year Statute of Limitations for Claims
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY AND IRREVOCABLY BARRED.
Governing Law & Exclusive Judicial Forum
These Terms, and all claims or causes of action based upon, arising out of, or related to this Agreement or the Services, shall be governed by, and construed in accordance with, the laws of the Republic of India, without giving effect to any choice or conflict of law principles. Subject to the arbitration provisions above, the courts located in India shall have exclusive territorial and subject-matter jurisdiction.
Suspension, Revocation & Termination
Attenomy reserves the absolute unilateral right, without prior notice, liability, or refund, to immediately terminate or suspend your access to all or part of the Services for any violation of these Terms, suspected security tampering, or any conduct that we determine harmful to our platform or users. All provisions regarding intellectual property, warranty disclaimers, limitations of liability, indemnification, and dispute resolution shall survive termination.
Severability, Force Majeure & Entire Agreement
Severability: If any provision of these Terms is found to be illegal, invalid, or unenforceable under applicable law, such provision shall be severed or modified to the minimum extent necessary, and all remaining provisions shall continue in full force and effect.
